Lawyers are considered to be extremely logical, reliable and with good communication skills. While knowing how to think like a lawyer is a truly fascinating skill, the law course is not for everyone. This article will give some ideas both to those who have decided to pursue a legal career, and to those who simply want to be able to have the last word in a debate.
Steps
Step 1. Identify the problem on the fly, and get used to it always:
this process must become automatic. You will see that with time and practice, and following your instinct, you will be able to quickly understand the problem, and remember it for the future. Always evaluate the other "side of the coin" too: the problems you face are hardly the same as those of others.
Step 2. Pay close attention to everything you read, write and listen to
This makes it easier for you to identify the problem, and subsequently to argue your thesis.
Step 3. Determine why a certain situation happened that way
Is it due to personal gain? Or for the common good? Does it only affect your client or all people like him? Is it fair, impartial? Can you use it against anyone?
Step 4. Try to look at the situation from another point of view and take advantage of the weak points
If you had to support the opposite text, what would you do? Always remember your goal, and where you want to go. It benefits your interest and that of the client, so if you think you have no arguments in favor of a certain position, think carefully about whether it is worth supporting.
Step 5. Look at the situation from the outside:
it is not important how you would deal with it. What matters is to evaluate in a neutral way, with detachment, and to verify if there are extenuating circumstances.
Step 6. Always support what you say with objective evidence
The facts must substantiate your thesis, otherwise it will not be convincing.
Step 7. Learn to be concise
Too many words create confusion.
Advice
- Get a notepad for notes.
- Sometimes you will find yourself forced to deal with absurd situations because, having the duty to represent your client, you will have to care about changing your way of thinking.
- Develop contacts with lawyers, judges and with all the figures who work in the legal field to understand their "modus operandi".
